Advising & Problem
Solving
Periodically, students with
disabilities run into problems implementing their acommodations. This may be
because an instructor is unfamiliar with how to assist in the process, the
student may feel unsure or intimidated about advocating for their needs, or the
class is designed in such a way that it is not readily clear what
accommodations would be appropriate. Whatever the problem, Disability Services
staff members are available to assist students in considering options and
working on creative solutions. We often facilitate communication between the
student and instructor or help arrange meetings with the student, instructor,
and or other staff who may have important ideas or information. Students, staff
and faculty are encouraged to contact Disability Services early when problems
first come-up, so that we can all start working on resolving them as quickly as
possible.
Student Rights &
Responsibilities
Complaint Processes
The Americans with Disabilities Act,
or ADA, is an amendment which safeguards the rights of people with disabilities
in public accommodations, employment, and education. New decisions are
frequently handed down by the United States Supreme Court. These decisions
further clarify how people with disabilities are to be accommodated at work, at
school, and in the community. Lane Community College is committed to
compliance with the ADA, and will assist the student in obtaining academic
accommodations, or offer students other resources as needed.
Disability Services has formal and
informal steps students can use to resolve disagreements concerning their
academic accommodations. Most of these problems can be resolved quickly, but
others may take longer. Everyone involved will do his or her best to ensure
that the process goes smoothly. It is the student's responsibility to start
this process as soon as the problem arises -- don't wait until it becomes a
terrible clash.
When you and your instructor
disagree about an accommodation, we recommend you follow the following steps as
listed; however, you may start at any step:
Step
1: Discuss the situation directly with your instructor.
Step 2: Discuss the situation with your Disability Services
Advisor. Your Advisor will discuss the situation with your instructor.
Step 3: The Disability Services Director may discuss the
situation with your instructor, then his/her supervisor if necessary.
Step 4: If you are still not satisfied you may wish to file a
formal ADA complaint. Your Disability Services Advisor can explain the process
to you.
When you and a Disability Services
staff person disagree about accommodations, we recommend you follow the steps
listed; however you may start at any step: Step 1: Discuss the
situation directly with the Disability Services staff person with whom you are
having the disagreement.
Step 2: Discuss the situation with your Disability Services
Advisor (if he or she is not the person you are disagreeing with). If he/she
supports your accommodation request, he/she may discuss the situation with the
Disability Services Director. If the Director does not support your request,
you may skip to step 3.
Step 3: Discuss the situation with the Director of Student
Services. They will gather all of the facts and decide either to grant you the
requested accommodation, recommend an alternative accommodation, or to support
the staff person.
Step 4: You may wish to make a formal ADA complaint. Your
Disability Services' Advisor will be able to explain the process to you.
